These Terms of Service ("Terms") govern your use of HoopScape (the "Service"), operated by Linwis Ventures LLC ("HoopScape," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use HoopScape. You may use the Service in your work as a coach for athletes of any age, but the account itself is held by an adult.
Your account
You are responsible for the activity that happens under your account, for keeping your sign-in credentials secure, and for the accuracy of any information you provide. Notify us at support@hoopscape.app if you believe your account has been accessed without your permission.
Your content
You retain ownership of the drills, practices, diagrams, videos, posts, and other content you submit through the Service (your "Content"). By using the Service, you grant HoopScape a worldwide, non-exclusive, royalty-free license to store, process, reproduce, display, transmit, convert, and create the technical derivatives needed for video and to show shared or community Content to the audience you select — solely for the purpose of operating the Service for you (for example, syncing your library across your devices; converting a video so it plays reliably on other devices; producing a cover image; applying the edits you ask for; and, if you choose to share, making your Content visible to the users you authorize).
This license exists only to run the Service. We do not use your Content to advertise, we do not license it to anyone else, and we do not use it to train machine-learning models.
We are not a backup service. Keep your own copy of any footage that matters to you. We take care with your Content but do not guarantee to preserve it indefinitely.
You are responsible for your Content. Don't post Content that violates someone else's rights, that is illegal, threatening, harassing, hateful, or otherwise objectionable. We may remove Content that violates these Terms or that is reported by another user.
Video: rights and permissions
Video records real people and may include youth players. Before uploading or recording video through HoopScape, you represent and warrant that:
- you own the footage or otherwise have the rights necessary to upload and use it;
- you have the permissions, releases, or other legal authority required for the people depicted and for the intended use;
- where parent or legal guardian permission is required for a minor shown in the footage, you have obtained that permission;
- if you upload on behalf of a team, club, school, league, or other organization, you have authority to do so; and
- you are not using footage in a way that conflicts with restrictions under which you received it.
A team, school, club, league, tournament, or media release may satisfy some or all of these requirements if it actually covers the relevant use. You are responsible for determining whether it does.
You are not required by these Terms to obtain a separate HoopScape-specific release from every incidental person who happens to appear in the background. You remain responsible for complying with applicable privacy, publicity, recording, intellectual-property, and other laws.
If you cannot make these representations for a particular clip, do not upload it.
You or your organization must maintain reasonable evidence of permissions or authorizations required for content you provide through HoopScape. If we receive a complaint or reasonably need to verify your authority to use particular content, we may request that evidence and may temporarily restrict or remove the content while the matter is reviewed.
If permission or authority on which you relied is withdrawn and you no longer have a legal basis to continue the use, you are responsible for removing or restricting the affected content as appropriate.
If you are a parent or guardian and you did not agree to this, you do not have to go through the coach. Use the form at https://app.hoopscape.app/privacy-request, or email privacy@hoopscape.app, with enough detail to identify the video and we will remove it. You do not need an account, and you do not need to explain why.
We do not offer video download or export. Once a file can be taken off the platform, these promises stop being enforceable — there is no way to honour a withdrawn permission for a copy that has already been passed around. Keeping video inside the Service is what makes deletion mean something.
Video: organization and community access
Organization video. Video designated for organization access may be viewed by the uploader and authorized current members of the applicable organization.
Shared links. A drill or practice may be shared through a link that can be opened without a HoopScape account. Sharing the drill or practice does not make attached video anonymously playable. A viewer must authenticate with HoopScape and satisfy the applicable video-access rules before the attached video can be played.
Although HoopScape controls access within the Service, we cannot guarantee that an authorized viewer will never make a screen recording, photograph a screen, or otherwise reproduce content outside HoopScape.
Video: sharing with the HoopScape community
Organization-only is the default. Every video you upload starts as organization video and stays that way unless you choose otherwise. Publishing a drill to the community does not share its video.
Sharing video with the community is a separate, deliberate step, and we ask you to confirm it separately. The confirmation you gave when you uploaded the video covers organization use; it is not treated as authorization to distribute the video more widely. Before a video is shared with the community you will be asked to confirm that you have the rights, permissions and authority required for that broader use, including any parent or legal guardian permission required for minors shown in the footage.
Who can watch community video. Signed-in HoopScape users who can reach the community drill it is attached to. Community video is never available for anonymous public playback, and a shared link does not make it playable.
Screening happens before community viewers can watch, not after. When you request community sharing, the video is screened as described below. Until that screening passes, the video is not available to community users. You and members of your organization keep access throughout — broadening a video cannot take it away from the people who already had it.
If screening does not pass, the video does not become community-visible. It remains available to you and your organization, and we may hold it for review. We will not present a screening outcome as a finding about you.
You can narrow it again. Returning a video to organization-only does not require a new confirmation. If you later share it to the community again and the video file itself is unchanged, we rely on the previous screening result rather than screening it a second time. If the file has changed in any way, it is screened again before community viewers can watch it.
Community content is moderated. If a community post is hidden or removed, any video attached to it stops being available to community viewers.
Video: automated screening
Video kept to organization access is not routinely screened automatically solely because it was uploaded.
When you choose to share a video with the HoopScape community, HoopScape samples frames across the video and uses Google Cloud Vision SafeSearch to evaluate those frames for adult, violent, or racy visual content before the video becomes available to community users. By sharing a video to the community, you authorize this processing.
We may also use automated screening or additional review when content is reported or otherwise requires a safety review.
Automated screening has limitations and is not a guarantee that HoopScape has detected every unlawful, harmful, unsafe, objectionable, or Terms-violating element of a video. We may hold, restrict, review, block, or delete content when appropriate to enforce these Terms or respond to safety or privacy concerns.
Child safety
Child sexual abuse and exploitation (CSAE) is absolutely prohibited on HoopScape. This includes any sexual content involving a minor, sexualized depiction of a minor, grooming, sextortion, trafficking, or any other exploitation of a child — whether real, edited, or generated.
We do not tolerate child sexual abuse or exploitation. If we become aware of apparent child sexual abuse material or other exploitation, we will take appropriate action, which may include restricting content, preserving information where legally required, reporting to the National Center for Missing & Exploited Children (NCMEC) or other appropriate authorities where required, terminating accounts, and cooperating with lawful investigations.
To report child-safety concerns, contact our designated child-safety contact at privacy@hoopscape.app, use the form at https://app.hoopscape.app/privacy-request if you do not have an account, or use the Report action on any post or video inside the app — you never need to leave the app to make a report. We act on child-safety reports as a priority and as soon as reasonably practicable.
Community posts
Drills you publish to the community feed are visible to other HoopScape users. Treat the feed as professional space. There is zero tolerance for objectionable content or abusive users: do not post content that is harassing, hateful, threatening, sexually explicit, or otherwise objectionable, and do not harass, abuse, or impersonate other users.
You can report any post and block any user from your feed at any time (each community post has Report and Block actions; blocked users are managed under Profile → Blocked users). We review reports and will remove violating content and remove or ban repeat or serious offenders, promptly and as soon as reasonably practicable. We may remove any post or restrict any account that we determine, in our reasonable judgment, violates these Terms.
Acceptable use
Don't:
- Use the Service to break the law or to harm others.
- Attempt to reverse engineer, scrape, or interfere with the Service or anyone else's use of it.
- Misrepresent your affiliation with a team, school, or organization.
- Use the Service to send unsolicited messages or commercial promotions to other users.
Prohibited content. Do not upload, post, record, or share content that:
- Sexually exploits or endangers a child in any way (see "Child safety" above — this is the one we treat most seriously).
- Is sexually explicit, pornographic, or depicts nudity.
- Depicts or promotes violence, self-harm, or cruelty, or shows a real injury for shock value.
- Harasses, bullies, threatens, defames, or demeans a person or group, including on the basis of race, ethnicity, religion, disability, sex, gender identity, or sexual orientation.
- Promotes hate, extremism, or terrorism.
- Depicts illegal drug use, or the sale of drugs, weapons, or other regulated goods.
- Violates another person's privacy, publicity, recording, intellectual-property, or other legal rights, including footage for which you lack permissions or authorization required for the intended use.
- Was recorded somewhere people reasonably expect privacy, such as a locker room, changing area, or bathroom.
- Infringes anyone's copyright, trademark, or other rights — including broadcast footage you do not own.
- Contains someone's private personal information.
We may remove any of it, with or without notice, and we act on reports of prohibited content promptly.
Intimate images shared without consent. Sharing an intimate image of an identifiable person without their consent is prohibited, and that includes an image that has been edited, synthesised, or generated to appear to be them. If you are the person depicted, email support@hoopscape.app with enough detail to identify the content; we will remove it and any known copies as a priority and as soon as reasonably practicable, and we will not require you to explain yourself or prove your identity beyond what is needed to find it.
Law enforcement. We may preserve content and account information, and disclose it, where we believe in good faith that we are legally required to, or that doing so is necessary to prevent serious harm.
Termination
You can delete your account at any time from the Profile screen. We may suspend or terminate your account if you violate these Terms or use the Service in a way that risks harm to other users or to the Service itself.
Disclaimers
The Service is provided "as is" without warranties of any kind, either express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Service will be uninterrupted or error-free, and we are not responsible for athletic outcomes, injuries, or losses arising from the use of any drill or practice plan in the Service.
Limitation of liability
To the maximum extent permitted by law, HoopScape and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with the Service.
Changes to the Service or these Terms
We may change the Service or these Terms over time. If we make material changes to these Terms, we'll announce them in-app or by email to the address on your account before they take effect. The "Last updated" date at the top of this page reflects the most recent revision.
Governing law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Tennessee.
